The legal saga of the South Bend "police tapes" took another turn this week as a ruling by the Indiana Supreme Court makes possible a trial to finally decide whether the long-sought-after-records can be released.

On Thursday, the state's supreme court announced it won't hear the case, meaning the case will move back to St. Joseph County on the authority of an Indiana Court of Appeals ruling in June. That ruling held that a group of current and former South Bend police officers did, in fact, have legal standing to challenge the South Bend Common Council's subpoena of the tapes.


The tapes, which supposedly contain racist comments and discussions of illegal activity, were created in the winter of 2011 and led to former Mayor Pete Buttigieg demoting Darryl Boykins, the police chief at the time, in 2012, and involved questions of whether the tapes violated the federal wiretapping act.


Now, the case will likely be returned to St. Joseph County, where the parties would either seek to settle the matter or prepare for a trial to determine the legality of releasing the tapes. When the case will move forward locally, however, is unclear.


The state supreme court denying to hear the case is the latest turn in a long legal struggle over the tapes that has led to a federal criminal investigation, generated multiple related lawsuits and became a topic in the presidential campaign of Buttigieg, who now serves as the U.S. Transportation Secretary.

The police department in Wilmington, N.C. has fired three police officers after investigators say footage from one of their patrol cars showed them exchanging racist and sometimes threatening remarks.


"There are certain behaviors that one must have in order to be a police officer and these three officers have demonstrated that they do not possess it," Williams said. "When I first learned of these conversations, I was shocked, saddened and disgusted. There is no place for this behavior."


According to an internal investigation, a police sergeant conducting a monthly review of police footage uncovered the remarks on June 4. The nearly two-hour long video came from a camera in Piner's patrol vehicle that was "accidentally" activated. After listening to the video for a short time, the sergeant heard "extremely racist" comments from the officers.


The video, according to the documents, shows Piner engaging in two separate conversations, one with Gilmore and then a phone call with Moore. The discussions include racist language and comments disparaging Wilmington police officers and officials and anti-racism protesters.


In interviews with investigators, all three of them said they were venting, citing what they called the current climate for police. They also denied being racist. Moore also said his comments were recorded when he was off-duty, calling Piner from his home.


If you work in a safety or construction industry, you may have heard the term "caution tape" used to refer to a wide variety of barrier messages, even ones which don't include the word "caution". Just as Americans might be in the habit of using the word "rollerblades" when referring to inline skates of any kind (or a plethora of other hyper-specific misnomers), people have also come to use the term "caution tape" to refer to barricade tapes of any kind.


The truth is, what people are often referring to is more accurately called "barricade tape". While "caution tape" refers specifically to the yellow polyethylene tape which contains caution messaging, barricade tape refers to any polyethylene tape, with or without messaging of any kind, put into place to create a barricade around a perimeter and increase caution.

I liked the tape but it did tear off a bit of the top layer of skin near one of my eyes. I have the same issue with scotch tape sometimes which is why I wanted to try this product. I would just suggest putting it on the back of your hand to take off some of the adhesive first.


It's not a complete fail but scotch tape works better. Unfortunately this tape really doesn't stick to the skin well because it's essential masking tape which doesn't stick well with natural skin oils.

The storming of the U.S. Capitol yesterday by a mob of supporters of President Donald Trump, which you can read more about in The War Zone's rolling coverage during that event, almost immediately produced a flurry of already iconic images. These include photographs of plainclothes police officers barricading the door to the floor of the House of Representatives with their Glock pistols drawn.


On closer inspection, a number of those pistols have reflective red-and-white striped tape on the sides of their slides. Tomer is now the head instructor at the Israeli Tactical School in Virginia, which provides training services for U.S. military and law enforcement groups, as well as security forces from around the world. Although he had no direct knowledge of the Capitol Police's specific policies, he confirmed that the application of the tape is not a totally uncommon practice. It is used to differentiate "non-combatants from combatants in a crowded situation," and helps officers make the right split-second decisions as to whether to engage a target or not.


We can't tell from the photos what exact models of this popular pistol the officers were armed with, but we do know that the Capitol Police was issuing the Glock 22, which is chambered for the .40 caliber Smith & Wesson cartridge, as of 2019. That year, one of the force's members accidentally left one of these guns behind in a bathroom stall in the Capitol, an act of carelessness that has happened more than once in recent years. That also raises a possibility, albeit one that seems much less likely, that these tape markings could be some kind of method for quickly identifying misplaced guns as belonging to that force, rather than a weapon belonging to a potential criminal. 041b061a72
